ISLAMBAD: Chief Justice of Pakistan Justice Iftikhar Muhammed Chaudhry said Murree and Chhanga Manga are the ground realities of politics in the country, where ministries have to be gifted to court political support, Geo News reported Thursday. The CJ Chaudhry said this while heading a 17-member larger bench hearing constitutional petitions filed against Eighteenth Amendment in the Constitution. Wasim Sajjad, the counsel of the federal government continued his arguments today, saying the Chief Justice has precedence in the new procedure of appointments of the judges, as he heads Judicial Commission instituted for the purpose.

The judges said in their remarks that if Parliament is active, so is the apex court as well, adding the new modus operandi for the appointment of judges is not part to the basic body of the Constitution. Pakistan News: The hearing of petitions in the Supreme Court challenging the 18th Amendment has been resumed, APakistanNews.Com reported on Monday.
A larger bench of the Supreme Court headed by Chief Justice Iftikhar Mohammad Chaudhry is hearing the case.
During the course of hearing, Federations counsel argued that the inclusion of article 2-A did not cast positive impact on the Constitution, while Justice Khalilur Rehman Ramday said that the said article makes the basic structure of the Constitution. Justice Ramday observed that parliament was there when the judges were sacked on November 3, 2007, and it supported the act. The judge added that it seemed that whenever the judiciary is assailed, the parliament would act as a silent spectator. He stated that the judiciary would be restored only when the public would took to street and die. He questioned how would the government would run if the parliament legislates wrongly and the judiciary is not allowed to review the move. Waseem Sajjad contended that nowhere in the world the basic structure of the constitution could be amended.

ISLAMABAD: A 17-member larger bench of Supreme Court, headed by Chief Justice of Pakistan (CJP) Iftikhar Mohammed Chaudhry, continued hearing petitions challenging 18th Amendment today (Monday), Geo news reported. Judges, in their remarks regarding their restoration occurred last year said, “Our restoration was result of public pressure”.

The hearing of petitions in the Supreme Court challenging the 18th Amendment has been resumed, APakistanNews.Com reported on Monday.

During th4e course of hearing, Justice Tariq Pervez observed that the people took to streets to get the judges restored and not the parliament. Governments counsel Waseem Sajjad argued that in his speech on August 11, 9147, Quaid-i-Azam stressed upon the sovereignty of the parliament. The CJ remarked that Quiad also called for elimination of corruption and jobbery, and posed a question that has the government done away with these menaces. The Chief Justice added that all the problems facing the country emerged due to non-implementation of Quaids sayings. Justice Khalilur Rehman Ramday said that he could live sans freedom but not in an environment full of corruption.Waseem Sajjad contended that judiciary is the creation of Constitution and thus it is not authorized to scrap any of its clause.

Higher Education Commission chairman Javed Leghari called on President Asif Ali Zardari at the Presidency and updated him on the fake degree issue.

According to sources, HEC chief has expressed his inability to work for the commission because of reported pressures and threats he had been receiving since he had started scrutiny of education degrees of lawmakers on a Supreme Court order.

Leghari presented a report on fake degrees and the names of politicians whose cases might be sent to the Election Commission for further action.

It is pertinent to mention that The HEC chairman had called on Prime Minister Yousaf Raza Gilani at Prime Ministers House on Monday and presented him the report.

Secretary Election Commission Ishtiaq Ahmed said that a senior officer will monitor the scrutiny of degrees. He said that no action would be taken against the interests of the country.
In a press conference in Islamabad, he said that Law Ministry will appoint new members of the EC. He said some decisions have been taken on degrees after the consultation and it is also requested to the Supreme Court to guide on degrees issue. He said that EC is a national institution and we wants to restore peoples confidence in it.
